everyone walking, should be paying attention. If you hit this, you are at least 50% at fault unless you are blind.

The only thing that should be in my way while I'm walking on a sidewalk is another person. I shouldn't have to move to avoid a vehicle at ground level or 3 feet in the air.

Yes, we wouldn’t want pedestrians to take responsibility or pay attention to their surroundings now would we?

Of course they should. But at the same time, this is clearly a situation where someone's actions have introduced a hazard that needn't exist.

You mean the walking/moving pedestrian who walks into the completely still back of the truck because they aren’t paying attention, or they think they are too important to make an effort to step around it? Yes, the pedestrian is at fault here.

The truck owner introduced a hazard. They are at fault here.
