I have a neighbour who poisoned a fabulous big tree of mine by crawling through a neighbour's property to reach over their fence to get to mine.
i have nothing more to add but if you come up with a good way of dealing with it, I'm all ears.
I am not above getting even.

If you know another tree is a likely victim, set up security cameras and familiarise yourself with r/treelaw !

Put them in the bin?

Poison his law, but keep in mind it doesn’t have to be all of it… you can create a variety of different patterns that will sit there for agessssss

Can I make a suggestion?
Google “espaliered” trees. Go show it to your neighbour and explain to him that you want to block the wall, but not go higher and you would like to espalier some apple or quince trees.
Build a frame in front of his wall and then do the espalier and make apple or quince jelly in the future!!
I get you want to block the fence but your neighbour doesn’t want to lose solar access or get leaves.
An espalier might be a solution.

We did have a bushes that followed the border of the land, but they had to be removed for his wall the be built, and when we replanted them, they all died.

Yes but if you show the neighbour photos of what you are going for and get them on board they might not die.

Well its worth a shot, and if he doesnt like it, might need to just plant some bamboo.

First talk to your neighbor directly.
Then if he/she is a bad person, verify if his/her wall respect the codes of your town and make their lives miserable if not. Or if the wall is OK, take a big hammer and hit the wall once every day up until you’ve demolished it. Or, I don’t know be creative!

I think we can conclude the neighbour is a bad person if they went straight to poisoning trees. They should have been the one to talk to OP in the first instance.

One of my neighbors killed my mom’s bushes that were along the fence a few years back. My mom called the cops on them and used the money that crazy lady had to pay for killing the plants to install cameras. You should definitely call the cops because it’s definitely illegal (Vandalism, destruction of property- though you don’t have to press charges.)

We plan on installing cameras, to catch him in the act and threaten him with legal action

Buy a big fancy kids super soaker, fill it with shugar water, and have fun spraying your neighbours house every couple of days , front and back , lawns, and paving . Ants and bugs love shugar water, so in a couple of months, they will be living in the ant pallace.

Set up a camera. Put a big fake tree or bush. Catch them and have them arrested.
Then they will have a record. After that anytime you call the cops the cops will believe you and not them.
Besides it's criminal mischief. Looks really bad on their record. Harsh punishments too.

Do you have proof?

u/DS_WizzerKill 1d ago
We have spoken to him about it, and he openly admits to it, so yeah we got proof

If it wouldn’t cause problems for your own garden, I’d highly recommend planting some tree of heaven.

Mix a solution of water vinegar and sugar, this mimics the right fruit that wasps and hornets eat so just get a super soaker or hose and just don't get caught in the act. Spring is coming up so attracting enough hornets in the backyard won't be pleasant if they find the neighbor's threatening

Dumb question maybe and if so I apologise, but how do you know it was them?

As I don't condone your neighbours actions, what type of trees are they exactly cause a lot of trees have invasive Roots the worst one is the ficus trees
I have a neighbour who's pine trees are right next to our fence and that is resulting in root damage on my side of the fence they are displacing/destroying the ground turning it into a tripping hazard, I'm just lucky we don't have any piping in that area as the roots can break through an block up and destroy the pipes

I'd fight them.
I'd go to them at their front door and say, "if you want to bring death to my property then I'm going to bring pain to yours." Then I'd punch them and just stare at them and say, "You gonna keep ficking up my trees? Because I can continue."

These trees are very close to his property and risk encroaching on it over the years? In addition, they risk damaging the wall in the future.

Neighbor can ask for them to be removed instead of poisoning them. Only shitty people do that. Talk out your problems, don't poison plants.
2
u/Business-Plastic5278 1d ago
Those trees werent poisoned.
They have been planted too close to the wall and they arent getting enough sun or water. Eyeballing them some idiot also hacked them back too hard and that will be crippling them as well. They should be a couple of meters away from the wall to be able to grow properly.
Note that the trees are covered in green shoots, note the bush near the base that is growing fine, note the trees on the other side of the wall very close by. If it was poison they would be dead too and half of the neighbors yard.

Neighborhood relations are always complicated and yes, it would have been wise to communicate before acting.

Well there is one thing that called common sense and it's lacking a lot nowadays. I mean if you know it's gonna be an issue why do it the first place ?
There's another thing that's called empathy.
Btw i dont know where you live, but here in France you cannot have a tree this close to the field boundary, it's need to be at least 2 meter and you cannot exceed 2 meter of size if it's this close from what i remember, so there might be rules About it in your country too.

Well, he asked us to cut the tree down to avoid any leaves from going into his pool, therefore we did as he asked (you can see the tree is aound the same height as the wall). He has also been killing our trees for the last 15 years. When this wall was built (about 4 years ago), he deliberately destroyed (using the digger that was used to dig the foundations of the wall) one of our pine trees that was about 2 meters into our garden.
Edit : I should also mention that his wall does not respect the rules on walls, the maximum height authorised is 2 meters, and his is 2.34 meter.

Have you sought legal advice? If not, you’ve been documenting this and have the means then you absolutely should.
2
u/DS_WizzerKill 1d ago
You can raise complaints through the townhall but the issue is the fact that his wife works a said townhall. But we are looking for some other ways we can take action against him
1
u/Better_Courage7104 1d ago
Use the recordings from your cameras of him poisoning and do small claims, might even be large claims with how much trees cost.
3
u/DROOPY1824 1d ago
He’s been doing this for 15 years and you still haven’t installed a camera?
1
u/DS_WizzerKill 1d ago
We would need about 10 different cameras to watch the entire border, we already have 2 installed but since he has no logic over which tree he poisons, we havent got him on video in the act
1
u/DROOPY1824 1d ago
My dude that’s like $500 in cameras that would have paid for themselves after 1 tree had been vandalized.
Don’t get me wrong, dudes an asshole, but you’re not helping yourself either.
1
u/DS_WizzerKill 1d ago
No your right, but i would somehow need to convince my parents to get 8 more cameras

Poison your neighbour's trees as payback
