That implicit trust in body language is contradicted by the scientific evidence, according to Denault: humans’ ability to make inferences about a person’s thoughts or character may be weaker than we typically think.

Some courts agree. One Colorado judge reversed a court sentence that hinged, in part, on how a defendant’s body language changed during questioning by a police officer, after noting previous cases that found body language to be inadmissible as evidence of guilt.

But body language continues to be used to imply a party’s guilt.

For example, the criminal complaint against [LM], who is accused of killing the United Healthcare CEO in New York City on 4 December 2024, explicitly mentions his body language. When asked by a police officer if he’d been to New York recently, [LM] “became quiet and started to shake,” the complaint notes.

The fact that it’s mentioned in official documentation suggests the authorities thought body language said something important about [LM], Denault says. “The problem is what would have happened if someone innocent also shook and became quiet,” he says.

“And I can tell you a million circumstances where someone honest could start to shake and be quiet.”

[LM] has pleaded not guilty to all charges brought against him in connection with the incident, and the matter is yet to come to trial. The significance of, and weight given to, the references to his body language is therefore, as yet, unknown.

Personal Opinion Why is sentencing Luigi Mangione to death a risky bet for the prosecution and the Trump administration?

The accusation may be determined to kill him, but they're taking a big risk by wanting the death penalty. If they convict him and execute him only to find out he was innocent, Trump will have to fight. His popularity isn't as high as it used to be, some in his own party are losing faith in him because of his collaboration with Elon Musk, and senior legal figures have vetoed several of his decisions. Executing someone who is not only very popular but who might also turn out to be innocent could cause big problems for Trump. After all, they tried to kill him before, and he came close, as the bullet passed close to his head. I think there's more to gain for both sides if Luigi were sentenced to prison.

Why is this important for LMs case?

Because it is an obvious government overcharge and overreach.

Why is this different than just only protesting for LMs freedom and justice?

When advocating for political prisoners, there is an understandable impulse to center their name and story, to personalize the injustice and demand their immediate release. However, while this approach may feel morally urgent, it carries significant strategic risks. By focusing narrowly on an individual, movements inadvertently provide authorities with a clear target for retaliation. Governments often exploit such cases to discredit broader dissent, painting activists as fringe supporters of a single "criminal" rather than challengers of systemic abuse.

The approach of protesting around the structural overreach that enabled the over charge in the first place, whether that’s unchecked surveillance, judicial corruption, or the criminalization of dissent. Systemic critiques resonate across ideological lines. Those hesitant to defend a specific prisoner may still oppose government corruption or eroded civil liberties, expanding the reach.

In NYC, these are all potential jurors protesting the bigger picture and obvious government overreach on all aspects of the population.

I had already been waiting for 1–2 hours, and I was in about the state shown in pic 4. Then Luigi passed by on his way back from the bathroom. Maybe he’d never seen a visitor more disheveled than the inmates, or maybe I stood out as possibly the only Asian person there (?) — he kept staring at me as he walked by. I looked at him several times too (but didn’t dare to stare), and before I could decide how to react, he had already walked past.

Why I didn’t greet or encourage him:** First of all, there was a pane of glass between us, and he was just passing by, so there was no real chance to. Subjectively, I was in total inner conflict — should I wave? Give him a thumbs up? Pretend I didn’t recognize him? My mind was a mess but outwardly I just had my arms crossed with a poker face (I regret it, I regret it, don’t scold me [cry emoji]). Plus, the other lawyers present were all calm and didn’t acknowledge him either. Luigi probably had serious matters to discuss and didn’t want to be disturbed. So for all those reasons, I didn’t interact with him further.

Since the beginning LM name had been tied to healthcare, vigilantes, porno, etc. I noticed this comment on his funding and it was nice to see a supporter of LM just for him - as it should be. He is an innocent, bright, kindhearted young man who embodies everything that makes a good human and he is languishing in prison as a political tool. These corrupted and wicked politicians really anger me and I wish they get removed from power. May God free LM from this ordeal sooner than later. He deserves to live free and happy.
