Empower messed up my "future allocation" that I set back up August 2024. Are they responsible for the market losses since then since they messed up?

It's not their mistake, unless you specifically told them to change your future contribution allocation in addition to your current balance allocation. In every 401k I have contributed to(including my current one), they are separate functions and require separate change requests - changing your current allocation WILL NOT change the allocation of future contributions.

However you need to read your arbitration agreement to see what's actually possible to pursue.

Actually current holdings and future purchases are controlled separately

I requested both to reallocate my my current balance AND also my future contribution. I know they are separate.

And you should have checked it at the next deposit period to verify it was correct. They ain't giving you shit
