Lawyers working for a death row inmate say he should not be executed because he’s 'too obese'.

Michael Tanzi, 48, who was found guilty of murdering Janet Acosta, 49, in 2003, is set to face the ultimate punishment on April 8 at Florida State Prison. However, his legal team has been desperately trying to prevent him from becoming the 11th person to be put to death in America since the start of the year.

In an appeal they filed last week, the defenders stated that Tanzi's weight would make the execution unlawful and lead to his “needless suffering”. The reason for this, they argued, is current death penalty ‘protocols’ should not be applied to someone suffering from obesity or illnesses associated with it.

The lawyers said Tanzi also has “severe chronic sciatica […] hyperlipidemia, uncontrolled hypertension, and gastroesophageal reflux disease”. The document read, per New York Post: “The existing protocols for lethal injection do not contemplate the execution of someone with obesity and uncontrolled medical conditions, like Mr. Tanzi’s, that are likely to complicate the lethal injection process. Executing Mr. Tanzi using the existing protocols is likely to cause serious illness and needless suffering.”

Janet Acosta was seated inside her parked van in April 2000 when Tanzi attacked her and threatened her with a razor blade, according to court documents. Tanzi bound and gagged the woman and began heading toward the Florida Keys in her van. Tanzi sexually assaulted Acosta at one point and used her bank card to take money from ATMs.

Tanzi eventually drove to an isolated area of Cudjoe Key, where he strangled Acosta and left her body, officials said. He then drove to Key West to visit friends. As Tanzi was making his way through the Keys, Acosta’s friends reported her missing. Police recognized the woman’s van and arrested Tanzi.

A Minnesota man believed someone told him that either he or his roommate “needed to die by midnight.”

Cody Kolstad proceeded to grab a loaded shotgun from an unlocked gun cabinet, walk up to the roommate who was sleeping in bed and blast him in the neck, killing him. Kolstad, 35, on Friday pleaded guilty to second-degree murder in the 2022 death of 41-year-old Brian Daniel Stoeckel.

After he shot Stoeckel at their home in the 100 block of 2nd St SE in Morristown, a town of less than 1,000 people some 60 miles south of Minneapolis, Kolstad called 911 around 12:40 a.m. on May 31, 2022.

He told dispatchers to “just come look,” a probable cause arrest affidavit said. He also said “just get here, please” and “bring the coroner.” When deputies from the Rice County Sheriff’s Office arrived, they found Kolstad facedown in the grass.

Madalina Cojocari will be 13 next month. She would be in junior high now were she back home in North Carolina, but instead she remains missing almost three years after she disappeared without a trace.

Now, new details about that disappearance are being brought to light thanks to newly unsealed search warrants.

The newly unsealed warrants, which allege that Madalina's mother and stepfather burned her belongings, paid thousands to a priest in her home country of Moldova and informed Madalina's grandmother of a large bag of cash she had hidden away.

Authorities did arrest Diana Cojocari and her husband, Christopher Palmiter, just a few weeks after she disappeared, but having served time for that crime, the two are now free.

Now, Diana is back home in Moldova, even as no one can find her daughter.

Among the newly unsealed warrants filed in the case is one seeking access to the family home.

In that warrant, Det. J.J. Sarver of the Cornelius Police Department writes that he went to the home of Cojocari and Palmiter to speak with the two and saw evidence of a fire pit in the backyard.

That is when Palmiter told him that Madalina's "mattress, clothing, Halloween costume and family photos" had been burned in the pit in the weeks since she went missing, according to the warrant.

Meanwhile, Det. Gina Patterson of the CPD sought access all of Diana's known bank accounts in a series of warrants tied to payments allegedly made by the mother.

The first financial decision that drew suspicion occurred days after Madalina went missing, when Diana made the first of two payments to a priest in Moldova that totaled $4,000 in the end, according to the affidavit.

She also said in a phone call with her mother from prison that she had hidden a large bag of cash, a separate affidavit states.

In none if the calls, however, did Diana or Palmiter say anything about Madalina's whereabouts.

Madalina was last seen exiting her school bus on Nov. 22, 2022.

Search efforts for Madalina did not get underway until three weeks later, when the girl's school forced Diana to address her daughter's truancy, according to the probable cause affidavit. That delay in reporting Madalina missing is what led to charges being filed against Diana and Palmiter.

A grand jury then indicted both Diana and Palmiter on a single count of failing to report the disappearance of a child.

Court records show that Madalina moved to the United States with her mother in 2016, when Diana wed Palmiter.

Prosecutors entered an image from that day as evidence when Palmiter stood trial last year, which ended with a jury convicting him for failing to report his stepdaughter missing, He was sentenced to 30 months probation.

Diana entered a guilty plea to a single count of failure to report a child missing one month prior, but the judge credited her for 521 days time served and ordered her release the following day.

Just last week, the couple finalized their divorce according to court records.

A Louisiana man with a prior child sexual abuse conviction has been found guilty of molesting his girlfriend’s young daughter.

Lawrence Burt, 48, was convicted of indecent behavior with a juvenile on Friday, March 28. He now faces between two to 25 years in prison, according to a press release from the Louisiana District Attorney’s Office.

Per trial testimony, deputies from the St. Tammany Parish Sheriff’s Office were dispatched to a Pearl River residence in March 2022 “in reference to a sexual abuse complaint.”

Upon arriving at the residence, deputies spoke to a woman who said her 8-year-old daughter had been touched inappropriately by her boyfriend, the release said.

A twisted New Jersey special education teacher allegedly exchanged more than 25,000 text messages with the middle-school boy she is accused of sexually assaulting, according to a seven-count indictment.

Freehold Intermediate School’s Allison Havemann-Niedrach sent thousands of messages to the 15-year-old victim starting when the alleged abuse began in early 2024, and stopped in June with her arrest, according to the indictment.

Authorities began looking into Havemann-Niedrach, 44, in June, after the school’s vice principal told investigators he was worried about her relationship with the eighth-grader — after another teacher reportedly spotted her “rubbing the victim’s neck and back.”

The teacher also alleged they saw Havemann-Niedrach “flirting with him and noticed her touching his leg.”

The victim allegedly told friends he was dating the married teacher.

Talking to cops, though, the boy said he was dating Havemann-Niedrach’s daughter, insisting the educator did nothing inappropriate, the documents read.

But the texts on his phone proved otherwise, authorities said.

Over 25,000 text exchanges were recovered from the alleged victim’s phone.

Prosecutors previously said the former teacher was “obsessed” with her alleged victim, People reported.

The boy was brought to the police station by his mother days later, and he admitted having sex with Havemann-Niedrach.

Havemann-Niedrach was formally charged Tuesday with single counts of aggravated sexual assault, child endangerment through the manufacture of child sex abuse materials, official misconduct and sexual assault, as well as three counts of endangering.

She has been on home confinement in Jackson since posting bail after her initial arrest last year.

The disgraced teacher is the mother of two small children. Havemann-Niedrach started working at Freehold Intermediate in March 2022.

A teenager allegedly shot his mother and stepfather to death at their home in Wisconsin, then fled from the state with plans to go abroad.

Nikita Casap, 17, was arrested on Feb. 28 in Kansas, weeks after police said he murdered his mother, 35-year-old Tatiana Casap, and his stepfather, 51-year-old Donald Mayer. According to a criminal complaint filed on March 26, police believed that based on their evidence, the couple was killed on or about Feb. 11, and Nikita Casap reportedly stayed at the home with their bodies for several days before he allegedly took the family car and fled the scene. Police were alerted to the family’s home on Feb. 28 when the school Nikita Casap attended called Waukesha police to conduct a welfare check after the teenager had failed to show up for class for two weeks.

When police arrived, they encountered a grisly scene.

According to the complaint, police were met with “the odor of decay” and noticed something covered by a blanket in the hallway. Upon removal of the blanket, police found a woman wearing a winter coat. Her face, according to the complaint, was “blackened with decomposition.” She was eventually identified as Tatiana Casap. An autopsy would later reveal that she had four bullet wounds — in the neck, upper torso, abdomen, and wrist.

In the home’s office, police found the deceased body of Mayer with “an obvious wound” to the back of his head. His body was “covered by blankets and pillows.”

Police also said that the family dog was missing, as well as Mayer’s car. The complaint outlined the investigation that tracked Nikita Casap’s whereabouts using phone records, security cameras, and financial transactions allegedly made with his parents’ credit cards. The police timeline tracked Casap’s purchases with his parents’ cards in Waukesha from Feb. 12 through Feb. 23.

During that time, according to the complaint, Nikita Casap responded to texts on his stepfather’s phone to make it appear that he was still alive. One recipient of those texts was Mayer’s mother, who told police in an earlier criminal complaint obtained by local Fox affiliate WITI that she was getting “weird text messages” from her son’s phone on Feb. 23. Mayer’s manager at work reportedly received a text from his phone on Feb. 24 that read, “Due to unfortunate circumstances, I will be out for another week.” Both recipients told police that the texts were uncharacteristic of Mayer.

Nikita Casap was also allegedly caught on cameras inside the house, the complaint stated. In home security footage from Feb. 16 to Feb. 22, the teen was seen entering the rooms where the bodies of his parents were located. Police said that he was allegedly seen lighting candles by his mother’s body and taking photos of his stepfather. Detectives said Nikita Casap could be heard on the cameras by his stepfather saying, “So you can see him there. I can literally see the f—ing rotten body there.”

Police also spoke to a witness who stated in their interview that Nikita Casap had allegedly disclosed that he planned to kill his parents as well as himself. She told police that he told her, “he had a happy childhood, but wanted to know how it felt to not exist.” According to the complaint, the witness repeatedly told the teenager that he needed to get help and reportedly attempted to discourage him from following through with his alleged plans. He told her that if she shared what he said, “it wouldn’t end well.”

After police tracked down Nikita Casap in Kansas and took him into custody, they downloaded the contents of his cellphone. During her interview, the witness told police Casap was reportedly in touch with “a male in Russia.” (Nikita Casap and his mother are originally from Moldova.) Evidence found on Nikita Casap’s phone revealed conversations from January that he had on the Telegram app that indicated he wanted to flee to Ukraine. He allegedly told an unknown recipient, “So while in Ukraine I’ll be able to live a normal life? Even when it’s found out I did it?” During another conversation, when the person he was reportedly communicating with responded in Russian, he wrote, “Also I should probably brush up on my Russian, because I can understand just fine but speaking it is harder lol.”

On Feb. 8, just days before police believed the alleged double murder took place, Nikita Casap’s phone sent a message about money he was receiving that read, “That includes the headphones as well? Quality one to protect from hearing gunshots of a .357 Magnum. Just making sure.”

During his March 27 court appearance, the judge set bail at $1 million. His next court date is April 9.

A babysitter in Kansas made a shocking discovery while attempting to prove to one of the children she was looking after that there wasn't a "monster" hiding underneath the bed.

On Monday, March 24, at around 10:30 p.m. local time, authorities responded to "a reported disturbance call" at the 2000 block of Patton Road, which is just outside the city of Great Bend, the Barton County Sheriff's Office confirmed in a Facebook post on March 26.

"Upon arrival the deputies contacted the victim who stated she was babysitting children at the residence. When putting the children to bed, one child complained there was a 'monster' under their bed," police said.

"When the victim attempted to show the child there was nothing under the bed, she came face-to-face with a male suspect who was hiding there. An altercation ensued with the babysitter and one child was knocked over in the struggle. The suspect then fled the scene before deputies arrived," the post added.

Martin Villalobos Junior, 27, has since been arrested and transported to Barton County Jail, officers confirmed. The post stated that the suspect had once lived at the residence but there was "currently a protection from abuse order issued against him to stay away from the property."

Despite being unable to locate Villalobos Junior after searching the area on the evening he was found under the bed, officers continued to look for him the following morning.

"The suspect was seen in the 2000 block of Patton Road at which point he attempted to flee from law enforcement. After a short foot pursuit, the suspect was captured," the police post stated.

Officers confirmed the suspect had been "booked on requested charges of aggravated kidnapping, aggravated burglary, aggravated battery, child endangerment, felony obstruction of a law enforcement officer and violation of a protection from abuse order."

Villalobos Junior is "being held in lieu of a $500,000 bond," police said.

Officers were called to Wilson Elementary School on March 18 in response to a call from the school principal about a teacher allegedly exposing himself to students.

Once officers arrived on the scene, they were informed by Principal Maliki Wojcicki that three sixth-grade students had come to his office and reported witnessing their teacher urinating into a can during class the previous day, according to an arrest report filed by officers in Maricopa County Superior Court.

Those three students then met with police and said that after hearing what sounded like “falling water” during class, they looked around for the source of the noise and discovered it was coming from the front of the classroom, according to the report.

All three students alleged to police that they then watched as 52-year-old Curt Hinton urinated into a container under his desk, according to the report.

The report also notes that all three of those students claimed they could see Hinton's genitals as he urinated into the container.

Officers then interviewed a fourth student from the class who claimed she, too, witnessed Hinton urinating into a container at his desk, says the report.

Police visited the classroom where the alleged incident took place and noted that the teacher's desk was "not enclosed," meaning it would be possible for the students to have witnessed their teacher urinating in class.

After speaking with the students, police questioned Hinton about the incident.

The educator allegedly admitted to officers that he had been teaching at Wilson Elementary School on March 17 and did, in fact, urinate into a container while in the classroom, according to the report.

Hinton allegedly told police that he needed to urinate but couldn't get in contact with another teacher to cover his classroom because he didn't know any other educators at the school, according to the arrest report.

He allegedly went on to tell police that he decided his best option in that moment was to discreetly urinate into a can — like he did during his time in the military, when he could not move from a location.

Hinton noted, however, that he had covered himself with his hand and did not believe any of the students in the classroom had been able to see, the arrest report alleges.

Police charged Hinton with four counts of indecent exposure. He later appeared before a judge in Maricopa County Superior Court and was given a $10,000 secured appearance bond, according to court records.

Hinton, who is an English Language Development Educator, according to his LinkedIn profile, was placed on administrative leave according to a statement from a school spokesperson.

That statement also noted that the school was cooperating with police and then detailed the bathroom policy for teachers.

"Wilson Elementary School District prioritizes the safety and supervision of students at all times. While there is no specific policy solely addressing teacher restroom use, it is standard practice for teachers to ensure appropriate coverage for their classrooms when they need to step away briefly," the statement reads, in part. "This typically involves coordinating with a neighboring teacher, instructional aide, or school administrator to ensure students remain supervised."

On Monday evening, the school spokesperson said that Hinton had resigned.

A doctor in Hawaii is under arrest after police say he struck his wife with a rock and tried to push her off a cliff — all because she reportedly did not want to take a picture with him.

The victim, who has not been publicly named, survived the Monday, March 24, attack in Oahu, Hawaii, but was in critical condition, the Honolulu Police Department said in a statement.

Law enforcement officials arrested Gerhardt Konig, an anesthesiologist in Maui by way of Pittsburgh, Penn., after a brief pursuit later on Monday evening.

Police allege Konig, 46, attacked his wife, 36, after she reportedly refused to take a photo with him, Hawaii News Now reported, citing police.

In response, Konig allegedly attempted to throw her off a hiking trail and struck her in the head with a rock, per police.

The woman suffered multiple injuries to her head and face as a result, Hawaii News Now reported, citing Honolulu Emergency Services.

During the incident, Konig also allegedly attempted to poke the woman with two syringes, Hawaii News Now reported, citing law enforcement sources.

The couple were at the Pali Lookout area, which stands at an elevation of 1,200 feet with “winds so strong that one can lean against the wall of wind,” according to the Division of State Parks.

It wasn’t immediately clear how far the woman fell.

Konig is a partner at The Anesthesia Medical Group in Maui, according to his Linkedin profile. Per Hawaii News Now, he was suspended from the practice pending investigation.

He is a former Attending Anesthesiologist at a women's hospital under the University of Pittsburgh School of Medicine. His profile on the university's website was not available on Tuesday.

Charges are pending in the case.

A Kansas dad is in custody and facing murder charges after his 3-year-old daughter allegedly shot and killed her 1-year-old sister — with their father’s gun.

Michael Tejeda, 25, is in the custody of the Sedgwick County Sheriff’s Office, online records show. He was booked on March 1, but recently released records offer insight as to what allegedly happened in his home the night of Feb 28.

According to an arrest affidavit, Tejeda called 911 that evening to report a shooting. He reportedly told the dispatcher that his 3-year-old daughter shot his 1-year-old daughter and can be heard asking the 3-year-old “why she did that.”

First responders rushed the 1-year-old was to a hospital, where she was pronounced deceased shortly before 9:30 p.m.

After being taken into custody, Tejada reportedly told police that after the children’s mother left, they were napping and watching television. Tejeda himself told cops he fell asleep in the living room and woke up at around 6 p.m. Two hours later, Tejeda got up and realized he had fallen asleep with his handgun in a prop holster in the front of his waistband. He reportedly told police that the fake holster didn’t have any retention and that a firearm could fall out if it turned upside down while in the holster.

Tejeda allegedly said that he removed the gun from his waistband and put it on the fireplace in the living room. He estimated the fireplace to be around 4 feet tall.

The girls’ father told police that he was in his bedroom changing his clothes when he heard a loud bang, after which his daughter ran toward her room crying. When he asked the girl what the sound was, the 3-year-old replied she was sorry and that it was his gun.

“He went into the living room and found [the 1-year-old] with a gunshot wound to her head while she was lying on the couch,” the affidavit reportedly says. “Tejeda said he found his firearm lying on the couch next to [the child].”

He reportedly told police that the 3-year-old daughter had been “curious” about the gun before and had commented on it. After the shooting at the home, the girl was taken to a child advocacy center for a forensics interview, where, she was reportedly “mostly interested in playing but did say she received an injury earlier in the day and received a Band-Aid.”

“She did not mention anything about the incident,” the affidavit noted.

The children’s mother, a 24-year-old woman not identified in reports, was allegedly at a friend’s apartment getting tattoos and had left the children in Tejeda’s care. She reportedly told police that she got a call from Tejeda as she was finishing up telling her the older girl shot the younger one, at which point she told Tejada to call 911 and immediately drove to the house.

The mother reportedly told police that when she arrived home, she immediately grabbed the 3-year-old, who kept saying she was sorry.

Tejeda has been charged with first-degree murder, criminal possession of a weapon by a felon, and two counts of aggravated child endangerment.

A man who was repeatedly raped by his own mother from the age of just 10 is questioning if his brother might actually be his son.

Brave bloke Logan Gifford, 26, revealed his terrible story and the years of awful abuse he suffered because of Doreene Gifford. His childhood was already laced with tragedy and Logan revealed he was exposed to drug use, while one of his brothers - he is the oldest of four boys - died after drowning in a pool at the age of three. The young tot spent months in a vegetative state.

At a preliminary hearing in 2015 Logan, from Las Vegas, testified that when he was around the age of 10 his mother took him into the bedroom he shared with his father and began to sexually abuse him while a pornographic video played on the TV. According to testimony, another shocking instance of sexual abuse then took place in late 2008. More acts of sexual abuse followed until around 2014.

Doreene Gifford has always maintained her innocence. She entered an ‘Alford’ plea after Logan revealed what occurred to a therapist.

An Alford plea is one where the accused maintains their innocence, but acknowledged they would likely be convicted if a case went to trial based on the evidence already collected by prosecutors.

A judge ordered Doreene to serve a prison sentence of eight to 10 years and register as a sex offender.

During a therapy session when Logan was 17, the therapist suggested his younger brother, born in 2009, might actually be his son, reports Las Vegas Review Journal.

“Look at the mess that I’m left with,” Logan Gifford said to the Las Vegas Review Journal. “I didn’t ask for any of this. I was a child when all of this happened and yet now I’m responsible for picking up the pieces of something that really is still continuing to have an impact in my life and dragging me to deal with that. I feel that as though it is my obligation or my duty to (him) to do this and find out who his biological father really is.”

Logan, who now has a college degree and works as an account executive, has now filed a paternity petition and said he is willing to have a test to determine if he is the father.

His brother is now living with him and Logan’s wife and stepdaughter while he has temporary guardianship.

Logan’s lawyer Timothy Treffinger has said the case will be one of custody if Logan turns out to be the father, but will be a guardianship case if he is not the father.

Determining if the boy is Logan’s son could be difficult as he will also have the DNA of Logan’s father Theodore Gifford, but Logan has said he wants to care for the boy regardless of the outcome of a paternity test.

“To sit here and say that my brother may be the product of my sexual assault is a very visceral thing to think about as a male survivor,” he said. “But he’s here now. The Journal reported that Doreene’s public defender said in a sentencing memorandum that there was animosity held by Logan towards his mother and that there were inconsistencies in his version of events.

The memorandum also said she suffered abuse at the hands of her parents and the foster care system in her childhood and in her marriage and also abused drugs, methamphetamine in particular.

She is now in jail at the Florence McClure Women’s Correctional Centre in Las Vegas. She was released on parole in July last year before she was arrested at the beginning of this year having violated a condition of her release that she have no contact with her victim.

Logan said she attempted to contact him via a third party and also tried to add one of his brothers as a friend on Facebook.

Another parole meeting is set for April, the same month Doreene’s sentence is due to end.

A Wisconsin man who allegedly threw a baby over a second-story balcony now faces felony charges and sits behind bars.

Jaimann Eiland, 31, was arrested March 15 after prosecutors said he “intentionally threw” a 1-year-old girl from the balcony of the Milwaukee, Wisconsin home of the baby’s mother Shakira Walters, whose age was not available.

According to a criminal complaint, an argument erupted between Walters and Eiland on March 13 after she heard her baby crying. WITI reported that the altercation escalated, and Eiland allegedly retrieved a knife and told Walters, “You gon’ die today.”

Per the criminal complaint, the argument continued to become more heated, leading up to Eiland allegedly grabbing the little girl by her head, dangling her over the second-story balcony of the home, and dropping her onto the wet lawn outside, narrowly missing an air conditioning unit. Eiland then returned to the house, the complaint said, and allegedly physically attacked Walters.

WISN, a local ABC affiliate, spoke to Walters who told the outlet of the little girl, “She could’ve died. She could’ve gotten really hurt from that, and I’m just mad.” Walters told WISN that despite the fall, the little girl only suffered minor bruising. But she told the outlet that she believed that Eiland “was definitely trying to kill my baby.”

According to the criminal complaint, the investigation began when officers responded to Froedtert Hospital, where Walters took herself and the baby after the alleged brawl with Eiland, who was identified as the ex-husband of Walters’ mother.

The baby was treated for minor injuries while Walters was treated for a sprained finger and a laceration to her forehead that required three stitches. Walters also reportedly had a swollen hand and pain in one of her legs, and her shirt was stained with blood.

Police stated in the criminal complaint that a bloody knife was found at the home.

During an interview after Eiland was taken into custody, he reportedly told police that he and Walters engaged in a “tug-of-war” with the baby before he allegedly tossed her off the balcony. Eiland admitted that the fight had gone too far after the baby’s fall, but that he did not believe he went overboard.

Eiland was booked into the Milwaukee County Jail after being charged with substantial battery with a domestic abuse modifier and child abuse. After his court appearance on March 17, bail was set at $15,000, and if he is able to post bail, he will be required to wear an electronic monitoring device upon release. If released, he is ordered not to contact Walters and other family members. His next court appearance is on March 24.

A former Indiana math teacher faces multiple new sexual abuse charges.

Five more victims — including a 13-year-old — have accused Brittany Fortinberry, 31, of sex crimes, prosecutors allege.

She is facing additional counts of child molestation, dissemination of matter harmful to a minor, contributing to the delinquency of a minor and one count of sexual misconduct with a minor.

Last month, Fortinberry was charged with multiple crimes including sexual misconduct with a minor, dissemination of matter harmful to minors and contributing to the delinquency of a minor involving three of her students, one of which was 15 at the time. The alleged incidents occurred in 2023 and 2024.

Fortinberry resigned from the Metropolitan School District of Martinsville on August 23, 2024, a spokesperson said, per FOX59. Five more victims have since come forward, prosecutors said.

One of the teens, who was 13 at the time, told authorities that Fortinberry drugged him and his friends before sexually assaulting them at her house.

When the victims didn’t want to participate with Fortinberry, she allegedly told them, “Just let it happen,” according to WTHR.

In one case, Fortinberry allegedly purchased $600 worth of items for a group of teens making them don the Ghostface masks from the Scream film franchise, before sexually assaulting them. She allegedly warned the teens that if they told on her, she would commit suicide.

Another teen says she sexually assaulted him after asking him to babysit her children.

Authorities began investigating in August 2024 after two high school students reported to staff that the Eminence High School math teacher allegedly sent them “inappropriate” Instagram messages and videos of her sex toys and a stripper pole in her Martinsville home, according to a police probable cause affidavit.

Authorities began investigating a different incident on Dec. 10, 2024, after a woman went to the Morgan County Prosecutor’s Office alleging that her grandson “disclosed to her sexual acts that happened between him" and Fortinberry when he was 15 years old, per a second affidavit.

Per the affidavit, when asked by police about the allegations against her, Fortinberry did not say she regretted her actions. Instead, she told the officer she "regrets the day that she lost weight" and "doesn't think she would run into any of these issues if she was still 150 pounds heavier."
