Not any time soon. Morena party supporters seem happy with the decision, as the sitting government and allies have been repeating that this will ensure a more transparent judicial branch. Any criticism is met with statements such as "So you hate poor people" or "You don't want the people to make a decision".

The only hope I have is that the cost of the elections will cause support to waiver and the government to backtrack a bit with the scope of this new reform. According to the INE (an independent state organism in charge of overseeing election processes) the elections caused by the reform will cost around [MXN$13,000,000,000 or USD$639,928,485.30](https://www.elfinanciero.com.mx/nacional/2024/10/27/reforma-judicial-cuanto-costara-la-eleccion-por-voto-popular-de-jueces-y-magistrados/). To put that into magnitude, the last executive election process cost around MXN$12,428,000,000 or USD $612,246,778.00.

Finally, to this day secondary laws haven't been drafted so in reality we still don't know very well how the whole elections will take place. Secondary laws normally act as the ruleset for a given law. En teoría puedes encontrar trabajo ahí y hacer networking. La neta está llena de gente pretenciosa pero creo que puede ser una buena herramienta para algunos trabajos.

I’m not entirely sure about the process in the US since I mainly reside in Mexico. That being from my understating you’re correct and the US has a mixed system where some people are elected and others are appointed. That being said, it is important to keep in mind that normally police don’t fit into the judicial power as they normally are a part of the executive branch of a given state. Nonetheless, it’s still pretty jarring to hear sheriffs are elected. Not sure I believe that is the best system.

The main reason why I think both ambassadors strongly disagree with the reform is because they align more with the idea that this change may cause the organized crime to more easily influence judges. In all honesty, elected or not corruption still exists. It’s a fact of life right now but I do agree that this reform will make it easier. If you think it about it, the idea would kind of work the same as when big corporations donate to certain campaigns. Normally the idea is that whoever is chosen more closely aligns with their objectives.

Alas, time will tell if it was actually a good decision or not. From my understanding Mexico is believed to be the first country to implement such a system. Personally I think that the reform is at its best impractical (considering every few years around 2k jugdes will be elected) and at its worst a ploy to reduce the weights and counterweights found across the three branches of government.

A democratic process is good for choosing people who will represent you (legislative and executive powers) however it isint that good for the judicial power as they aren’t there for the people. Their main objective is to make sure the letter of the law is followed. They represent first and foremost the law and constitution (at least we hope so right?).

The important aspect here is that in theory the best judge won’t elected but rather the most popular. I know that the previous system had flaws as nepotism, favoritism and corruption was present but this system doesn’t do anything to actually address that.

What some people will say is that a new state organism will be set in place to keep tabs on judges and possible malpractice. That this organism will help in reducing corruption, however, it wont be the case as the members of the organism will be chosen by the government. This is especially risky as basically whoever is governing at the moment will have some influence over the judicial system which is dangerous as it causes the different powers to work together instead of acting as weights and counterweights.

Finally, the election process actually only is meant for federal judges and not local judges (that handle most issues). Federal judges normally only handle Amparos which is a sort of federal protection of your rights. This legal figure is only used when you believe that the government is harming your rights and are acting against the law.

Lol it’s not about it stripping down corruption. The constitutional reform is at best flawed and at worst extremely harmful.

The main idea promoted by the current president and majority political party (Morena) is that by democratically choosing federal judges corruption will somehow lessen as the voice of the people will be heard.

In reality what this reform will cause that judges can basically be appointed and promoted by the ruling party as they will have the strongest backing. This isn’t ideal as even organized crime might fund certain judges.

In addition to the previous this has serious flaws as it mean that the judge won’t be the most prepared but rather the most popular. The way we had it before was that the judges had to spend years in the judicial system before being able to rise to that level. Now, it doesn’t mean that nepotism or corruption didint happen but at least some or the majority of judges had years of experience.

Another vital point of the reform is that a new state organism will be created that will oversee judges and any wrongdoings, however, the people that conform the organism will be elected by the government. This means that the organism will likely be biased.

Finally but not least. No face judges will be introduced for heinous crimes like organized crime. This is particularly controversial and dangerous as it is a slippery slope since who knows is the a bill another reform is suddenly passed that allows them to handle other lesser crimes. Another drawback is that you won’t know who is judging you which is awful as you won’t know is they have any biase nor will you be able to defend yourself.

La prima de antigüedad (Art 162 Fraccion III) se da en casos de despidos injustificados y cuando el trabajador tenga 15 años de antigüedad.

Por lo que este al ser un despido injustificado (no esta previsto en Articulo 47 de la LFT) entonces si se debe pagar la prima de antigüedad.

El patrón y el trabajador pueden acordar la duración y los horarios de la jornada como ellos prefieran. (Artículo 59.). Por lo anterior, no es necesario que cuenten con un trabajo fijo.

En cuanto a llevar sus herramientas. El llevar tus propias herramientas o no, no es un factor para determinar la relación laboral.

Artículo 20.- Se entiende por relación de trabajo, cualquiera que sea el acto que le dé origen, la prestación de un trabajo personal subordinado a una persona, mediante el pago de un salario.

Artículo 331.- Persona trabajadora del hogar es aquella que de manera remunerada realice actividades de cuidados, aseo, asistencia o cualquier otra actividad inherente al hogar en el marco de una relación laboral que no importe para la persona empleadora beneficio económico directo, conforme a las horas diarias o jornadas semanales establecidas en la ley, en cualquiera de las siguientes modalidades: I. Personas trabajadoras del hogar que trabajen para una persona empleadora y residan en el domicilio donde realice sus actividades. II. Personas trabajadoras del hogar que trabajen para una persona empleadora y que no residan en el domicilio donde realice sus actividades. III. Personas trabajadoras del hogar que trabajen para diferentes personas empleadoras y que no residan en el domicilio de ninguna de ellas.

Artículo 59.- El trabajador y el patrón fijarán la duración de la jornada de trabajo, sin que pueda exceder los máximos legales. Los trabajadores y el patrón podrán repartir las horas de trabajo, a fin de permitir a los primeros el reposo del sábado en la tarde o cualquier modalidad equivalente.

No es necesario ver ir tan lejos. Nuestra propia Ley Federal del Trabajo describe esta situación en su capitulo de "Personas Trabajadoras del Hogar" específicamente el Artículo 331. y en el Artículo 20.
