Unlawful detention
My husband and I returned from out of the country. We were stopped at customs because they say there is a restraining order against him taken out by me. This was in 2023 (it was a one year order) and we went back to court the very next month to get it dissolved once he entered rehab (he’s been sober since). But basically they’re saying the system from our home state never changed it. It would be expired anyway. I have the motion for dismissal on my phone in my files. He was taken to the local sheriff’s office. I hired an attorney here (FL) since the police weren’t giving me any answers. Is this considered an unlawful detainment? Is it my home states fault for not filing the correct paperwork? Is there anyway I can try to recoup the attorneys fees/missed flight fees/hotel and car I had to rent to stay here? Court costs?
